NAR keeping Clear Cooperation — with a key addition

A new complement to CCP will allow for “delayed marketing,” giving home sellers the ability to keep their listings out of the IDX feed and off search sites.

The National Association of Realtors has decided to keep its controversial Clear Cooperation Policy in place, but is adding some flexibility for home sellers who want to delay listing a home via the Multiple Listing Service.

The trade organization announced on March 25 that it is adding a new category of exempt listings called "delayed marketing exempt listings." This will allow a home seller the option of delaying marketing a listing through the Internet Data Exchange (IDX) for a period of time. The IDX feed allows real estate agents, brokers and home search sites such as Zillow to display MLS property listings.

Each MLS will have discretion to determine how long the marketing period will be based on their local market.

During the delayed marketing period, the home seller and the listing agent can market the listing based on the seller's needs. The delayed marketing exempt listing will still be available to other MLS Participants through the MLS Platform. 

In order to do a delayed listing, an agent must get a signed agreement from the seller.

The new change is effective immediately and must be implemented by Sept. 30, according to the NAR news release.

The Clear Cooperation Policy of filing a listing within 24 hours remains in place for sellers that do not opt for the delayed agreement.
